The Australian Competition and Consumer Commission is an independent statutory authority that promotes competition and fair trading in markets and protects consumers throughout Australia, administering the Competition and Consumer Act 2010 and a range of other legislation across the full breadth of the Australian economy. Competition law enforcement involves investigating and taking action against conduct that substantially lessens competition in markets, including cartel conduct such as price-fixing and market sharing agreements between competitors, misuse of market power by firms in dominant positions, and mergers and acquisitions that would have the effect of substantially lessening competition. The ACCC assesses proposed mergers and acquisitions that may affect competition, with parties to transactions that raise competition concerns required to provide information and submissions enabling the ACCC to assess the competitive impact, and with the ACCC able to accept court-enforceable undertakings or oppose transactions in the Federal Court where it determines that the merger would breach the Act. Consumer protection functions address misleading or deceptive conduct, unconscionable conduct, unfair contract terms, product safety, and a range of specific consumer guarantees that apply to goods and services supplied to Australian consumers, providing remedies including civil penalties, injunctions, corrective advertising, and compensation orders. The ACCC has taken an increasing interest in digital platforms and online markets, investigating issues related to the market power of large technology companies, algorithmic pricing, data practices, and the impact of digital platforms on competition in advertising, news media, and other markets. Enforcement of the Australian Consumer Law, which forms a schedule to the Competition and Consumer Act and is applied uniformly by the ACCC and state and territory consumer protection agencies, provides a comprehensive national framework of consumer rights and business obligations that applies regardless of the state in which a transaction occurs.
